Terms & Conditions

These Terms & Conditions (“Terms”) are a legally binding agreement between you and HabitSwipe, operated by A. Sarwer Hussain / Ray Viral Lab, 23/12, Ramasamy Street, Periamet, Chennai, Tamil Nadu 600003, India (“we,” “us,” “our”). They govern your use of the HabitSwipe apps, website, and related services (the “Services”).

By downloading, creating an account, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Apple’s Licensed Application End User License Agreement (Standard EULA) also applies to downloads from the App Store, to the extent required by Apple.

1. Eligibility

You must be at least 13 years old to use HabitSwipe. If you are between 13 and the age of majority in your country, you represent that a parent or guardian has reviewed and agreed to these Terms. You must have the legal capacity to enter this agreement.

2. The Services

HabitSwipe lets you track goals, habits, and routines, view progress (including calendars, grids, and analytics), set reminders, and optionally share updates, photos, and messages with people you invite. Features may differ by platform, region, or subscription. We may change, add, or remove features with reasonable notice when practicable.

3. Accounts

• You are responsible for your login credentials and for activity on your account.
• Provide accurate information and keep it updated.
• One person per account unless we expressly allow otherwise.
• Notify us promptly of unauthorized use at hussainint08@gmail.com.

We may suspend or terminate accounts that are inactive, insecure, or in breach of these Terms.

4. User content and license

You retain ownership of habits, notes, photos, videos, audio, messages, and other material you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit User Content solely to operate, improve, and provide the Services (including syncing to devices and showing content to friends you choose).

You represent that you have all rights needed to post User Content and that it does not infringe others’ rights or the law. You are responsible for backups of important data.

5. Social features and community rules

HabitSwipe is for close friends, not a public social network. Still, messaging, photos, and invites are user-generated. You agree you will not:

• Harass, threaten, stalk, defame, or exploit anyone
• Post sexual, pornographic, or exploitative content, especially involving minors
• Share others’ private information without permission
• Impersonate another person or misrepresent affiliation
• Spam, scrape, reverse engineer, or disrupt the Services
• Upload malware or attempt unauthorized access
• Use the app for illegal activity or to promote self-harm, terrorism, or hate
• Invite or target children under 13

You can block or report users and content in the app or by emailing hussainint08@gmail.com. We may remove content, limit features, or ban accounts. We are not obligated to monitor all User Content but may do so for safety and legal compliance (including Google Play and App Store user-generated content rules).

6. Subscriptions and in-app purchases

Some features may require a paid plan (for example monthly, yearly, or lifetime Pro). Prices are shown in the store listing and checkout screen and may vary by country and tax.

• Payments are charged to your Apple ID or Google Play account.
• Auto-renewing subscriptions renew unless you cancel at least 24 hours before the end of the current period in your store account settings (Apple: Settings → Apple ID → Subscriptions; Google: Play Store → Payments & subscriptions).
• Refunds are handled by Apple or Google under their policies, except where local law requires us to assist.
• We may change prices with notice as required by the stores and applicable law.
• Free features and paid features may change; we will not misrepresent what is included.

7. Intellectual property

The Services, including the HabitSwipe name, logos, design, software, and documentation, are owned by us or our licensors. These Terms do not transfer any ownership to you. You may not copy, modify, or redistribute our software except as allowed by law.

8. Third-party services

The app may rely on Apple, Google, hosting, and analytics providers. Their terms apply to their services. We are not responsible for third-party websites or store pages.

9. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HabitSwipe is a productivity and social tracking tool. It is not medical, mental-health, financial, or professional advice. We do not guarantee that tracking habits will produce any particular outcome or that the Services will be uninterrupted or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 50. Some jurisdictions do not allow certain limits; in those places, our liability is limited to the fullest extent allowed.

11. Indemnity

You will indemnify and hold us harmless from claims, damages, and reasonable legal fees arising from your User Content, your use of the Services, or your breach of these Terms, except to the extent caused by our own misconduct.

12. Termination

You may stop using the Services and request account deletion at any time. We may suspend or end access if you violate these Terms, if required by law, or if we discontinue the Services. Sections that by nature should survive (including intellectual property, disclaimers, limits of liability, and dispute terms) will survive termination.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence still apply. Courts in Chennai, Tamil Nadu, India have exclusive jurisdiction, unless applicable consumer law gives you the right to sue in your home courts. Nothing in these Terms limits rights you cannot waive under local law.

14. Changes to these Terms

We may update these Terms. We will change the “Last updated” date and, for material changes, provide notice in the app or by email when required. If you continue to use the Services after the Terms take effect, you accept the update. If you do not agree, stop using the Services and delete your account.

15. Miscellaneous

If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. Our failure to enforce a provision is not a waiver.
